mytestdrive is eCircle's free car test drive portal. You can select up to 3 of your preferred cars to take out for a test drive. eCircle will forward your contact details and your request directly to your regional advisor, who will contact you to arrange for a test drive with your preferred car(s) - free of charge and without any legal obligation.

• Registration
• • To use the portal, you have to register. Only persons at least 18 years old may register. By filling in all the required registration data and requesting a quote you enter into an agreement ("the agreement") regarding the use of the portal and the service provided at the provisions contained into these terms and conditions. The agreement entered into by you and eCircle will not be subject to any time limit. The agreement may be terminated by both parties at any time.
• Revocation
• • You have the right to revoke your declaration of intention within a period of one month e.g. by e-mail to service@mytestdrive.co.uk. No reasons need to be given for revocation.
• Availability
• • eCircle endeavours to make the portal available at all times. For technical reasons there is no entitlement to the constant availability of the portal. eCircle reserves the right to modify, restrict or discontinue the operation of the portal.
• Transfer
• • eCircle transfers the data entered by you when registering on the portal to diligently selected competent cooperation partners. eCircle's competent cooperation partners will contact you to arrange for a test drive with your preferred car(s) - free of charge and without any legal obligation. eCircle endeavours to provide a extensive network of competent cooperation partners but there is no entitlement to a test drive.
• Liability
• • Although eCircle endeavours to ensure the accuracy and quality of the portal and the service provided, the Service is provided on an "as is basis" and (i) we do not accept responsibility for any use of or reliance on the portal, the service and information provided or for any disruptions to or delay in the service; and (ii) we do not make any representations as to the accuracy, comprehensiveness, completeness, quality, currency, error-free nature, compatibility, security or fitness for purpose of the service or information provided. Changes are periodically added to the information herein. No warranty, term or condition, express or implied, is offered by eCircle in relation to the service or the information provided, except as expressly provided below.
  • eCircle is not liable for (i) losses not typically associated with this type of agreement, that are thus barely foreseeable and (ii) for any consequential or indirect losses or damages, whether in contract, tort or otherwise (whether such loss or damage was foreseeable, known or otherwise), especially not for any loss of revenue, actual or anticipated profits and opportunity; loss of anticipated savings; loss or corruption of, or damage to, data, systems or programs; loss of goodwill/reputation or wasted expensure.
  • eCircle does not limit or exclude liability for (i) death or personal injury caused by eCircle's negligence; (ii) wilful misconduct or gross negligence, (iii) culpable infringements of a main contractual duty of important significance for the carrying out of the aim of the agreement. eCircle does not limit or exclude liability under product liability law.
    Where liability is limited or excluded, this also applies to the personal liability of staff, representatives, subcontractors and other employees.
    The test drives are provided by eCircle's cooperation partners. eCircle is not liable for any damages in connection with the test drives.
• Data protection
• • In connection with the operation of the portal and the procurement of your request eCircle collects, stores, processes and uses your personal data. Detailed information regarding data protection is available in our privacy policy.
• Liability for links
• • On the portal you may be offered links to other websites operated by parties other than eCircle. eCircle is not responsible for the content of these websites. If eCircle gains knowledge of any statutory violations on these sites, the link will be immediately deleted.
• Amendment of these terms and conditions
• • eCircle reserves the right to amend these Terms and Conditions at any time. You will be notified of any amendments to these Terms and Conditions by e-mail. Any such amendments shall be deemed to be effective two weeks after the notification if you do not object in writing or by e-mail.
• Miscellaneous
• • The agreement and the use of the portal and the services provided are exclusively governed by these Terms and Conditions. Any other Terms and Conditions shall not become part of this agreement, even if eCircle has not expressly objected to their application. If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforceable. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic purpose of the invalid or unenforceable provision. The agreement is governed by the laws of the Federal Republic of Germany. If no other jurisdiction is mandatory, legal venue will be Munich.
